On Monday, August 5, 2024, Forbes reported that new details had emerged regarding trips taken by Supreme Court Justice Clarence Thomas with conservative megadonor Harlan Crow. According to the report, Senator Ron Wyden, chairman of the Senate Finance Committee, revealed that Thomas had taken additional trips with Crow that had not been previously disclosed, despite federal law requiring justices to report such travel.
This new information fueled further scrutiny of Thomas’s relationship with Crow and past ethical issues. ProPublica had first uncovered in 2023 that Thomas had accepted gifts from Crow over many years, including trips on his private jet and yacht, without disclosing them as required. While Thomas argued he was not obligated to report gifts from personal friends, two Senate committees investigating the situation found evidence of undisclosed travel, including time Thomas spent with Crow in Russia.
The investigations also revealed that Crow had paid over $6,000 per month in tuition for Thomas’s grandnephew to attend private school in the early 2000s, a gift the justice also failed to disclose as income on financial forms. Additionally, Thomas and his family sold their home and other properties in Georgia to Crow in 2014 without reporting the real estate transaction. These repeated omissions and discrepancies in Thomas’s financial disclosures raised questions about undue influence and potential ethics violations.
Concerns were exacerbated by Ginni Thomas’s active role in conservative political causes. Thomas’s wife lobbied lawmakers to overturn the 2020 election and was connected to groups that submitted briefs to the Supreme Court, where her husband served as a justice. Her conduct fueled demands that Clarence Thomas recuse himself from related cases to avoid apparent conflicts of interest. Ginni Thomas had also attended the rally preceding the January 6th Capitol attack and aided efforts to dissuade cooperation with the investigative committee, adding to recusal calls.
While Democrats in Congress pushed for investigations and new ethics rules, Republicans have generally dismissed the issues as partisan attacks. Thomas has avoided punishment so far, and the Supreme Court has declined to enforce its non-binding ethics code with consequences. With more undisclosed trips revealed and no signs of accountability, the debate over Clarence Thomas’s conduct on the nation’s highest court continues amid uncertain prospects for reform.
