On Monday, June 16, 2025, the New York State Commission on Judicial Conduct announced that William Alan Hohauser, a Judge of the District Court in Nassau County, agreed to resign from his position effective December 31, 2025, following allegations of misconduct.
The resignation comes after Hohauser was charged with making inappropriate and offensive comments to prosecutors and court staff on multiple occasions. As part of the agreement, he will not seek or accept judicial office in the future.
The Commission issued a Formal Written Complaint in March 2025, detailing incidents between February 2023 and May 2024 where Hohauser made inappropriate remarks to several Nassau County Assistant District Attorneys and a court employee. These actions persisted despite a prior caution from the Commission in May 2022 for similar inappropriate behavior toward attorneys.
To fulfill the terms of the resignation stipulation, signed on May 2, 2025, and accepted by the Commission on June 12, 2025, Hohauser completed mandatory courses on civility and professionalism provided by the Office of Court Administration. Additionally, the Commission recommended that he no longer be assigned to criminal cases.
Commission Administrator Robert H. Tembeckjian stated that: “Judges are obliged to be patient, dignified and courteous toward all with whom they deal in their official capacity. They undermine morale with rudeness toward staff, and public confidence in their impartiality with repeated discourte sy toward litigants , especially when aiming it at one party – in this case, prosecutors. That Judge Hohauser did so despite a prior warning is disappointing and warrants his departure from the bench.”
Hohauser, who has served as a Nassau County District Court Judge since 2016, was admitted to the New York State Bar in 1986. His current judicial term was set to expire on December 31, 2027.
