On Wednesday, February 5, 2025, Georgia Governor Brian Kemp accepted the resignation of Brenda Jennings, Chief Judge of the Heard County Magistrate Court, effective immediately. This resignation follows an inquiry initiated by the Judicial Qualifications Commission (JQC) concerning allegations of judicial misconduct against Jennings.

The inquiry, registered as JQC Complaint No. 2025-126, stemmed from multiple claims that Jennings violated the Georgia Code of Judicial Conduct. The allegations included her habitual absence from the court, the misuse of court staff for personal errands, and the improper handling of rental payments from tenants of her personal properties. The investigation revealed that Jennings instructed her staff to accept these payments and failed to report extra-judicial income accurately.
Additionally, the investigation highlighted Jennings’ lack of decorum while presiding over court proceedings. Reports indicated that she used profane language in the courtroom and engaged in prohibited ex parte communications, which are private discussions that could influence a case, thereby undermining judicial integrity.
The JQC’s Investigative Panel authorized a full investigation into these allegations after the initial review suggested that, if proven true, they would constitute serious misconduct. The panel found reasonable cause to believe that Jennings’ actions violated several specific rules outlined in the Code of Judicial Conduct, including maintaining public confidence in the judiciary, prioritizing judicial duties over personal activities, and ensuring courteous treatment of all court participants.
In a letter dated February 4, 2025, Jennings formally submitted her resignation to Governor Kemp. The resignation was promptly accepted by the Governor, marking a significant step in the ongoing investigation. In the letter, Jennings expressed her decision to resign in light of the allegations and the investigation, which was likely to continue without her presence on the bench.
As part of the resolution of the complaint, Jennings and the Investigative Panel reached a mutual agreement outlined in a Consent Agreement dated February 5, 2025. This agreement stipulates that Jennings will not seek or accept any future judicial position, whether elected or appointed. The panel deemed this resolution a fair disposition of the matter and in the interest of justice, thereby precluding further investigation or formal charges against her.
