On Monday, May 13, 2024, Tariq Ataliya filed an original action in mandamus with the Supreme Court of Ohio against Judge Joyce V. Kimbler of the Medina County Common Pleas Court.

In the filing, Ataliya explained that he became aware of an outstanding warrant against him on May 15, 2023, stemming from a criminal case in Judge Kimbler’s court, numbered 21CR0774. On May 22, 2023, Ataliya submitted a notice of availability and request for a speedy disposition pursuant to Ohio Revised Code 2941.401 to the Medina court. This law requires defendants to be tried within 180 days of providing such notice.

However, over a year later, on April 13, 2024, Ataliya’s case had yet to be resolved. He maintained in his complaint that his statutory speedy trial rights, as outlined in ORC 2941.401, have now been violated.

As relief, Ataliya asked the Supreme Court to compel Judge Kimbler to dismiss the indictment against him with prejudice for failure to meet the speedy trial deadline. Alternatively, he requested the high court order Judge Kimbler to explain why the writ should not be granted.
