On Thursday, August 24, 2023, the New York State Commission on Judicial Conduct recommended that Justice of the Darien Town Court in Genesee County, Jennifer R. Nunnery, should be censured for engaging in offensive and otherwise inappropriate behavior on Facebook and for improperly endorsing two candidates running for elective office.

The case is entitled “In the Matter of Jennifer R. Nunnery”.

The New York State Commission on Judicial Conduct has determined that Judge Nunnery should be censured. The said discipline is a result of her engaging in offensive and inappropriate behavior on Facebook, as well as improperly endorsing two candidates running for elective office. Judge Nunnery, who took office in January 2020, made several questionable posts on her publicly visible Facebook page. The posts included derogatory language, inappropriate comments, and improper endorsements of political candidates.

The News Release states:

“At some point after becoming a judge in January 2020, Judge Nunneryposted the following to her publicly visible Facebook page:

“Driving down the mean streets of Batavia after tanning and thought I recognized the ass of one of my favorite marines walking through the Tops parking lot lol… Good to see ya, ya f***ing boot!”

In the year 2021, Judge Nunnery engaged in further misconduct by endorsing candidates running for positions in Buffalo City Court and a local school board through Facebook likes. This action created, at minimum, the impression that she had endorsed these candidates.

The Commission acknowledged that Judge Nunnery promptly removed the troublesome posts when confronted by her supervising judge. The censure determination took into account her relatively new position as a judge at the time.

Administrator Robert H. Tembeckjian highlighted the importance of upholding the integrity of judicial office both on and off the bench. He emphasized that judges must be especially cautious when communicating on social media due to the potential amplification of inappropriate messages.
