On Thursday, August 22, 2024, WDSU reported that a first-degree rape trial in New Orleans was halted after a disagreement between the presiding judge and an assistant district attorney.

The trial of Freddie J. Sterling was underway when prosecutors called for Judge Benedict Willard to recuse himself from the case after a complaint was made against a male juror. According to court filings, the juror had allegedly made inappropriate comments to a woman from the District Attorney’s Special Victims Unit team. However, Judge Willard dismissed the complaint, telling the woman that she was the source of distraction instead.

The prosecution took issue with Judge Willard’s handling of the situation and filed a request to have him removed. However, Judge Kimya Holmes was tasked with reviewing the case transcripts and she ultimately denied the request. In her decision, Judge Holmes found that there was a lack of professionalism displayed in the courtroom by both sides that led to heightened tensions and emotions. She determined that both the judge and prosecutors acted inappropriately.

As a result of the dispute between the sitting judge and prosecution, the rape trial of Freddie J. Sterling had to be halted.
