On Sunday, December 8, 2024, Law&Crime reported that Seminole County Circuit Court Judge Wayne Culver declined to place an ankle monitor on James Lindsey, a domestic abuser who later allegedly stabbed his estranged wife, Kristin Stevens, up to 70 times. This decision has sparked significant concern regarding judicial oversight in domestic violence cases.

Lindsey, 42, had a history of domestic violence against Stevens, 40, and was arrested for domestic violence battery on November 6, 2024. At that time, law enforcement officials requested that Lindsey be placed under GPS monitoring to protect Stevens, but Judge Culver denied this request, instead ordering Lindsey to refrain from contacting her.

The violent incident occurred on December 5, 2024, when deputies responded to a call about a stabbing at Stevens’ home in Chuluota, Florida. Upon arrival, they found Stevens dead from multiple stab wounds. Another man, who had also been attacked, managed to escape to a neighbor’s house for help. A 16-year-old boy was present during the attack but was unharmed.

Sheriff Dennis Lemma stated that the surviving victim witnessed Lindsey assaulting Stevens in her bedroom. In his attempt to intervene, he was stabbed in the leg. Lemma estimated that Lindsey inflicted between 20 and 70 stab wounds before fleeing the scene. Hours later, Lindsey died in a single-car crash.

The case has raised serious questions about the effectiveness of judicial decisions in protecting victims of domestic violence. Lindsey’s violent history was known, yet the decision not to impose GPS monitoring has been criticized by community members and advocates for domestic violence victims. Sheriff Lemma described the incident as a heartbreaking event that has impacted both the victims’ families and the community.

Weeks after denying the GPS monitoring, the Florida Supreme Court suspended Judge Culver for 60 days without pay due to his conduct in unrelated court proceedings. Reports indicated that he had exhibited abusive behavior towards defendants in the courtroom. In one instance from February 2022, Judge Culver reacted aggressively when a defendant entered the courtroom looking for a seat. His loud response included profanity and threats of incarceration.

The Supreme Court’s suspension follows a series of recommendations from a disciplinary panel that investigated Judge Culver’s behavior. Although a settlement was initially proposed for a 60-day suspension, the court ultimately required a more thorough examination of his conduct.
