On Thursday, March 21, 2024, the Free Press reported that the 3rd District Court of Appeal had ordered Monroe County Court Judge Mark Wilson be disqualified from presiding over the murder trial of Preston Brewer.
Preston Brewer has been accused of fatally shooting Garrett Hughes in a Key West bar parking lot in 2023. Brewer’s defense counsel argued that Judge Wilson should not oversee the trial due to his wife’s role in the Monroe County State Attorney’s Office. Cristi Lyn Spottswood, Judge Wilson’s wife, currently serves as the director of finance and human resources for the State Attorney’s Office.
The appeals court agreed with Brewer’s legal team that Judge Wilson’s impartiality could reasonably be questioned due to his wife’s high-ranking position in the prosecuting office. As director, Ms. Spottswood oversees financial and personnel matters for the State Attorney’s Office, which is working with police to prosecute Brewer for murder. Given this relationship, the 3rd District Court of Appeal determined Judge Wilson should be disqualified to ensure Brewer receives a fair trial free of potential bias.
The murder trial will now be assigned to a new judge with no conflicts of interest. This ruling aims to maintain public trust in the integrity of the judicial process as Brewer defends himself against the serious criminal charge.
