On Friday, August 16, 2024, the Florida Judicial Ethics Advisory Committee clarified that judges must recuse themselves from cases involving defendants they previously prosecuted.
The Committee issued Opinion Number 2024-12 in response to an inquiry from a judge. The opinion cited Canons 2A and 3E(1) of the Florida Code of Judicial Conduct, which deal with maintaining integrity, impartiality and ensuring situations do not arise where a judge’s impartiality might reasonably be questioned.
The Committee found that for a judge to preside over a case involving a defendant they had previously prosecuted would create a reasonable perception that the judge would not be impartial. Even if no specific rules on recusal applied, the judge’s impartiality could legitimately be called into question due to their prior role as the prosecuting attorney against that defendant.
This stance differed from the Committee’s Opinion 2021-18, where a judge did not have to recuse from a failure to register a case even though they had originally charged the underlying sex offenses as a prosecutor. In that instance, the Committee determined the original charges and failure to register were distinct matters.
However, in this new inquiry, the judge seeking guidance had directly prosecuted the defendant on different charges in the past, not just filed the initial charges. This key difference made Opinion 2021-18 inapplicable as precedent.
The Committee advised that due to prosecuting the defendant previously, recusal was necessary to avoid any reasonable perception of bias if the judge were to preside over a new case involving the same defendant. The opinion aimed to maintain judicial integrity and impartiality as outlined in the Florida Code of Judicial Conduct.
The ruling provides clearer direction for Florida judges navigating recusal decisions when faced with defendants from prior prosecutorial careers. It prevents potential questions about fairness or impartiality that could undermine confidence in the judicial process.
