On Tuesday, June 27, 2023, the Commission on Judicial Performance of the State of California announced the transfer of the hearing to inquire into matters concerning Lassen County Superior Court Judge Tony R.  Mallery from Department 5 to Department 15 of the Superior Court of California.

The hearing is set to begin on July 10, 2023, at 9:00 a.m. on court days, from July 10-21, and August 15-25, 2023. Furthermore, the public will be able to attend and observe the proceedings.

In a Notice of Formal Proceedings filed on September 12, 2022, Mallery was charged with 21 counts of misconduct, including improper action as defined by Article VI, Section 18 of the California Constitution and conduct that was detrimental to the administration of justice and brought the judicial office into disrepute. Additionally, Mallery was charged with taking revenge on three workers for helping the commission.

Judge Mr. Mallery debunked all of the accusations and labeled the proceedings as an extension of the local attacks against him, in his Answer. 

According to the Commission’s announcement, the hearing dates may be subject to change by the special masters presiding over the hearing.
