On Thursday, March 7, 2024, Brandon H. Webb filed an original action in mandamus with the Supreme Court of Ohio against Judge Adam Myser of the Belmont County Municipal Court.
According to the filing, Webb is currently imprisoned at the Southeastern Correctional Institution in Lancaster, Ohio, serving time for an unrelated case. In July 2023, Webb was made aware of an outstanding warrant issued from the Belmont County Municipal Court regarding case 22CRA371N. Webb alleges that he promptly submitted a notice of imprisonment and request for speedy disposition of the charges.
The law, under Ohio Revised Code 2941.401, requires charges pending against incarcerated individuals to be resolved within 180 days of the inmate filing for speedy disposition. Webb states that over 180 days have now passed since his initial filing, and the Belmont County Municipal Court has failed to act on the pending criminal case against him. As a result of this inaction, Webb argues his right to a speedy trial has been violated.
Through this mandamus complaint, Webb is seeking to compel Judge Myser and the Belmont County Municipal Court to dismiss the original charge in case 22CRA371N with prejudice due to the violation of his statutory speedy trial rights. Webb is self-representing in this original action and filed an affidavit of indigence along with his complaint.
