On Thursday, February 5, 2026, the Texas Commission on Judicial Conduct suspended Fidencio M. Guerra, Jr., a senior Judge sitting by assignment in Hidalgo County, Texas. The suspension follows a complaint filed by Mark D. Atkinson, Executive Director of the Texas Center for the Judiciary.
The case is entitled “In the Matter of Judge Fidencio M. Guerra, Jr.,” with case number 26-0193.
The complaint alleges that Judge Guerra failed to meet the required sixteen hours of judicial education for the fiscal year 2025. This failure is considered a violation of the Rules of Judicial Education promulgated by the Court of Criminal Appeals, as well as Canons 2A and 3B(2) of the Texas Code of Judicial Conduct.
After reviewing the complaint and supporting evidence, the Commission concluded that Judge Guerra engaged in willful violation of the Texas Code of Judicial Conduct. The Commission also found willful and persistent conduct that is inconsistent with the performance of judicial duties and casts public discredit on the judiciary and the administration of justice, violating Article V, Section 1-a(6)A of the Texas Constitution.
The suspension was ordered pursuant to Article V, Section 1-a(6)A of the Texas Constitution and Section 39.003 of the Texas Government Code. The suspension of Judge Guerra is effective immediately and will remain in place pending final disposition by the Commission of the pending charge.
