Judge Norris recused himself from the case in June 2025, after allegations surfaced regarding comments he made suggesting one of the defendants was a gang member. Judge Sheryl Lipman took over the federal case.
According to court documents, Norris reportedly stated that the Memphis Police Department was “infiltrated to the top with gang members.” These remarks were allegedly made after a carjacking incident involving one of his law clerks, which occurred five days after the officers’ convictions. The comments raised questions about impartiality, prompting Judge Lipman to order a new trial.
The officers, Tadarrius Bean, Demetrius Haley, and Justin Smith, Jr., were convicted of witness tampering but acquitted of the more serious charge of violating Nichols’ civil rights by causing his death.
Nichols, aged 29, died three days after a 2023 traffic stop where he was pepper-sprayed, kicked, and punched by officers for alleged reckless driving. The incident sparked nationwide protests against police brutality.
