The case involved Vincent Acosta, who had pleaded guilty to the murder of three Grand Canyon University students: 18-year-olds Magdalyn Ogden and Abriauna Hoffman, along with 19-year-old Hunter Balberdi.
The tragic incident occurred in October 2022 when Acosta, allegedly under the influence of substances, drove the wrong way on Interstate 17, resulting in a collision that claimed the lives of the three students. The courtroom was filled with family and friends of the victims, who had gathered for the hearing, which lasted less than three minutes. During this brief session, Judge Dunne announced her recusal without providing any explanation.
In August, Acosta had reached a plea agreement with the Maricopa County Prosecutor’s Office, admitting guilt to three counts of second-degree murder. Each charge carries a potential prison sentence ranging from 18 to 22 years.
Prior to the sentencing hearing, it had become apparent that Judge Dunne intended to step back from the case, prompting notifications to the victims’ families about a possible postponement.
Following her announcement, Judge Dunne expressed regret over the inconvenience caused to those who had traveled to attend the hearing. She stated, “The court must revoke the case and appoint a new judge. The court apologizes to everyone on both sides who traveled here today for this.”
As a result of her recusal, the case will be reassigned to another judge, delaying the sentencing process for Acosta.
