On Tuesday, June 4, 2024, the Daily Beast reported that a judicial misconduct complaint filed against New York Judge Arthur Engoron related to his handling of a civil fraud case against former President Donald Trump has been dismissed.

Republican Congresswoman Elise Stefanik of New York filed the complaint last year with the New York State Commission on Judicial Conduct. Stefanik’s complaint raised concerns about “inappropriate bias and judicial intemperance” by Engoron in the case where the judge found Trump liable for fraud.

However, in a decision dated March 14th, the Commission dismissed Stefanik’s complaint without investigation. In a letter, Commission Administrator Robert Tembeckjian wrote that the panel “dismissed the complaint, having found no basis on the facts presented to commence an investigation.”

Stefanik had accused Engoron of illegally gagging Trump by limiting his attacks against court staff. She also claimed Engoron and his law clerk were “partisan Democrat donors,” though the clerk was running for local office.

In her 1,800-word complaint, Stefanik labeled Engoron’s behavior as “bizarre and biased” and argued his actions were “making New York’s judicial system a laughingstock.” She called on New Yorkers to speak out against the “dangerous weaponized lawfare against President Trump.”

However, the Commission’s dismissal means Engoron avoided facing potential discipline over the allegations. It also denies Trump ammunition to appeal the $364 million judgment issued by Engoron against him in the civil fraud case, which has grown larger with interest.

Legal experts note that politicians filing such misconduct complaints has become a common tactic used by Trump and his allies to disrupt unfavorable court cases. They say the complaints can intimidate judges even if ultimately dismissed.

But in this instance, the panel found Stefanik’s arguments against Engoron lacked merit, closing the book on the matter. It remains to be seen if Trump will continue appeals of the major fraud ruling that now stands firmly in place against him in New York.
