On Wednesday, August 14, 2024, The Hill reported that Judge Juan Merchan declined former President Donald Trump’s third request to recuse himself from overseeing the criminal trial related to hush money payments made in 2016.
Judge Merchan has presided over the case in his role as a New York judge. However, Trump’s legal team has repeatedly argued that Merchan’s daughter Loren, who works as an executive at a progressive digital agency, creates a conflict of interest. Loren’s employer has worked with current President Joe Biden and Vice President Kamala Harris, who Trump is competing against in the 2024 presidential election.
In their third request filed recently, Trump’s attorneys Todd Blanche and Emil Bove specifically pointed to Loren’s “long-standing relationship” with Vice President Harris, including past work on political campaigns. They claimed Loren had received and could receive “extensive financial, professional, and personal benefits” through this relationship.
However, Judge Merchan dismissed these arguments as “stale and unsubstantiated.” In his ruling, he noted that a state ethics advisory committee had previously determined he did not need to recuse himself. Merchan said “innuendo and mischaracterizations do not a conflict create” and recusal was “not necessary, much less required.”
The trial earlier this year ended in a guilty verdict on all 34 counts related to falsifying business records. Prosecutors from the Manhattan District Attorney’s Office, led by Alvin Bragg, had accused Trump of lying to hide payments made to Stormy Daniels during the 2016 election.
With Merchan maintaining his role, Trump is scheduled to be sentenced on September 18th unless the verdict is overturned. He has pledged to appeal, continuing his objections to Judge Merchan’s refusal to recuse from the high-profile case.
