On Wednesday, October 15, 2025, the Bedford Gazette reported that Judge Travis Livengood of Bedford County recused himself from cases involving Sawmill Campground and Cumberland Valley Township. The decision was made following a motion filed by campground owner Christopher Plunkett.

Plunkett’s motion marks the second instance where he has requested Judge Livengood to be replaced by another judge in cases involving himself and Cumberland Valley Township officials.

Before the recusal motion, Judge Livengood inquired whether Plunkett had new information to present since his previous request months prior. Plunkett asserted that his arguments were new, citing conflicts of interest, personal bias, and what he described as Judge Livengood’s consistent rulings against him. Plunkett emphasized that the judge had denied every motion he had submitted.

Initially, Judge Livengood denied the motion, stating that unfavorable rulings did not automatically imply bias or prejudice. He also noted that he had provided his reasoning for his rulings on the record. However, after a brief recess, Judge Livengood announced his recusal.

While stating that he did not believe there was a legal basis for his recusal, Judge Livengood explained that he took this step to expedite the progress of the cases. He expressed his apologies to the township, acknowledging the disruption but indicating he felt it was the only course of action.

The legal disputes between Plunkett and Cumberland Valley Township revolve around issues concerning the campground’s septic and drainage systems. The township claims that these systems are inadequate for the number of residents on the property. Plunkett has responded with allegations of corruption, abuse of power, extortion, and other retaliatory actions.

Numerous lawsuits have been filed between Plunkett and the Township. Christopher Plunkett is currently representing himself, while Cumberland Valley Township is represented by Attorney Brad Allison. A senior judge from another county will be assigned to preside over future hearings.
