On Thursday, November 7, 2024, 2 News Oklahoma reported that a petition demanding the resignation of Tulsa District Judge Sharon Holmes is gaining traction following a controversial sentencing decision. The petition was initiated in response to Judge Holmes’s recent ruling in the case of Shawn Canady, a 40-year-old man found guilty of sexually abusing two children. Despite a jury’s recommendation for a 40-year prison term—20 years for each count—Holmes sentenced Canady to 40 years of probation.

In September, a jury convicted Canady on two counts of child sexual abuse. The jury’s recommendation for a lengthy prison sentence reflected the severity of the crimes, which involved the sexual abuse of minors. However, during sentencing on October 28, Judge Holmes opted for probation instead of incarceration, a decision that has sparked outrage among community members and legal professionals alike.

Jon Scoggins, who has personal experience with similar abuse within his family, is one of the individuals leading the petition effort. He expressed his frustration over the judge’s decision, stating, “I hope enough Tulsans get mad enough about Judge Holmes not protecting our community and protecting our children and sign this petition.” Scoggins believes that the community must advocate for stronger measures to ensure the safety of its children.

The dissatisfaction with Judge Holmes’s ruling has also been echoed by Tulsa County District Attorney Steve Kunzweiler. He publicly expressed his disappointment, emphasizing the importance of accountability for offenders of such serious crimes. Kunzweiler remarked, “These are the types of cases where my heart literally aches. Law enforcement spends countless hours encouraging young victims to believe in the system—that their courage will be rewarded by a just disposition.” He further articulated that the judicial system must deliver justice, particularly for the most vulnerable members of society.

Kunzweiler underscored the danger posed by child sexual offenders, stating, “Of all the criminal perpetrators I have ever dealt with in my 35-year career, the rapists and molesters of children are the most dangerous for our community.” He emphasized that the community did not expect Canady to remain free after such a serious conviction, especially following a jury’s clear decision. His sentiments reflect a broader concern among community members regarding the implications of the judge’s sentencing choice.

As the petition continues to gather signatures, Scoggins and others involved are hopeful that it will prompt action from local leaders. The judicial complaint process, however, is known to be lengthy and complex, leading Scoggins to seek a more immediate public response.

Sharon Holmes, who has served as a district judge in Tulsa for several years, is currently in a term that is set to end in 2026.
