On Monday, March 31, 2025, Rep. Andy Biggs (R-AZ) introduced a resolution aimed at removing Judge James Boasberg, the Chief Judge of the United States District Court for the District of Columbia. The resolution cites Boasberg’s failure to adhere to the constitutional standard of good behavior as the basis for his removal.
According to Article III, Section 1 of the U.S. Constitution, Congress has the authority to establish federal courts and stipulates that judges may only hold their positions during good behavior. This provision is distinct from Congress’s power to impeach civil officers for serious offenses such as treason or bribery.
In his resolution, Congressman Biggs alleges that Judge Boasberg has interfered with President Trump’s foreign policy and has acted with partisan motives, which he contends constitutes misbehavior under the Good Behavior Clause. Biggs argues that such actions warrant the judge’s removal from office.
Biggs expressed concerns about what he describes as “activist judges” who overstep their authority and impose political agendas that conflict with the will of the elected President. He noted, “We cannot stand by while activist judges who incorrectly believe they have more authority than the duly-elected President of the United States impose their own political agenda on the American people.”
The congressman previously cosponsored resolutions to impeach Judge Boasberg but claims that those efforts would face significant obstacles in the Senate due to the requirement of a two-thirds majority for impeachment. Instead, Biggs’s current resolution proposes that judges can be removed by a simple majority vote in Congress, mirroring the process used for their confirmation.
Biggs emphasized the importance of upholding constitutional principles and defending presidential authority. He stated, “Judge Boasberg abused his judicial authority for political gain and is not in compliance with the constitutional Good Behavior Clause. He must not be permitted to remain in his position.”
