On Sunday, January 21, 2024, The Epoch Times reported that New York Representative Elise Stefanik recently filed another judicial complaint related to the ongoing civil fraud case against former president Donald Trump.

The complaint was submitted to the New York State Commission on Judicial Conduct against Judge Arthur Engoron, who is presiding over the case. Stefanik took issue with the New York Court of Appeals dismissing Trump’s appeal against a gag order imposed by Judge Engoron in October. The order prohibits Trump from making public statements about the judge’s staff.

Stefanik argued in the complaint that the dismissal raises constitutional issues. As a defendant, Trump should have the right to speak out against anyone involved in a case he believes has become politicized. She described the gag order as “election interference” since it impacts Trump’s ability to campaign as a potential 2024 presidential candidate.

Stefanik also warned that the courts’ decision could undermine public trust. She requested the Commission on Judicial Conduct to intervene, describing Judge Engoron’s handling of the trial as a “grotesque miscarriage of justice.” It is the third complaint Stefanik has filed against the judge over the past two months.

The case stems from a lawsuit brought by New York Attorney General Letitia James, alleging Trump inflated assets in financial statements between 2011 and 2021. During the initial trial proceedings in early October, Trump posted comments on Truth Social criticizing a law clerk, Allison Greenfield, for associating with Democrat Senator Chuck Schumer.

Judge Engoron issued the gag order and fined Trump $10,000 in response. He found Trump’s claims that the post referred to someone other than Greenfield as not credible. The order was later expanded to Trump’s attorneys. Trump’s legal team has argued it is unusual for a law clerk to have active involvement in a case in discussions with the judge.

The latest complaint was submitted ahead of Trump’s rally in New Hampshire over the weekend. Polls show Trump with a strong lead over other potential 2024 GOP contenders like Nikki Haley and Ron DeSantis. He urged his supporters to turn out and vote for him in the primary. Stefanik also spoke at the rally and has been rumored as a possible running mate if Trump runs for president again.

The Commission on Judicial Conduct will now review Stefanik’s complaint against Judge Engoron over the dismissal of Trump’s appeal and the ongoing gag order in the high-profile New York fraud case.
