On Thursday, August 1, 2024, Newsmax reported that House Judiciary Committee Chair Jim Jordan sent a letter to Loren Merchan, the daughter of Manhattan trial judge Juan Merchan who presided over Donald Trump’s recent business records case. In the letter, Representative Jordan demanded documents and communications from Loren Merchan relating to her past work for Kamala Harris and other Democrats.

Judge Merchan oversaw the criminal trial of former President Donald Trump, where Trump was convicted on 34 counts of falsifying business records under a novel legal theory. Representative Jordan’s letter noted that experts have raised concerns about potential political biases and conflicts of interest given Loren Merchan’s work for Democrats, including as director of digital persuasion for Kamala Harris’ 2019 presidential campaign. At the same time, the consulting firm Merchan worked for, Authentic Campaigns, received over $7 million for services provided to the Harris campaign.

In his letter, Jordan suggested Judge Merchan should have recused himself from Trump’s case due to Loren Merchan’s ties to Trump’s political opponents. Jordan wrote that the House Judiciary Committee is considering legislation that would allow a former president to remove a case to federal court if there are questions about political bias at the local level. Such a law, if in place earlier, would have prevented Judge Merchan from presiding over Trump’s trial, according to Jordan.

As part of its potential legislative response and ongoing oversight work, the Committee is seeking any documents or communications from Loren Merchan that could shed light on whether political bias factored into the Trump case. Specifically, Jordan’s letter requested materials by August 8 regarding Loren Merchan’s work for Democrats and the activities of Authentic Campaigns during her time there.

This comes a day after Trump’s lawyers sent their own letter asking Judge Merchan to recuse himself. Experts have testified to the Committee that Merchan made multiple errors before and during the trial that infringed on Trump’s due process and First Amendment rights. With the 2024 presidential election upcoming, Jordan wrote that Judge Merchan’s potential conflicts in the case against Trump implicate serious federal concerns.
