Scheindlin, who previously served as a federal judge in New York, also described Miller’s remarks as containing a “veiled threat” against judges, pointing to his comment that the policy’s success would depend on whether judges “do the right thing.”
Legal analyst Jeffrey Toobin, also on CNN, emphasized the severity of the proposal, noting that the only historical instance of a president unilaterally suspending habeas corpus was during the Civil War under Abraham Lincoln.
Scheindlin further warned that implementing such a policy could have significant economic consequences, including driving away international students and reducing associated revenue.
