On Tuesday, September 17, 2024, News12 Westchester reported that a retired judge from Orange County settled a sexual abuse lawsuit filed by a former student. The lawsuit, initiated by Karen Fain in 2019, accused Jeffrey Berry, who was a teacher at Cornwall High School at the time, of grooming and sexually assaulting her during her time as a student.

Fain’s allegations detailed incidents that occurred between 1970 and 1972 when she was a 16-year-old sophomore. The complaint claimed that Berry engaged in inappropriate conduct, including emotional manipulation and physical contact, ultimately leading to sexual abuse. According to the lawsuit, the abuse caused significant emotional and psychological distress for Fain, which has persisted over the years. She reported experiencing depression, anxiety, and other mental health challenges as a direct result of the alleged abuse.

The lawsuit was filed not only against Berry but also against the Cornwall Central School District and its Board of Education, citing negligence in their supervision and retention of Berry. Fain’s legal representatives argued that the district failed to create a safe environment for students and did not adequately train staff to recognize or prevent sexual abuse.

The case received attention when it was filed under the Child Victims Act, which allowed survivors of past childhood sexual abuse to sue their abusers and the institutions involved. The act created a one-year window for such legal actions, which prompted Fain to come forward with her allegations.

As the case progressed towards trial, a settlement was reached just before proceedings were set to begin. The details of the settlement have not been disclosed, but Fain’s attorney noted that it resolved the case to “everyone’s satisfaction.”
