On Tuesday, July 9, 2024, The Washington Post reported that two Democratic senators requested a criminal investigation into Supreme Court Justice Clarence Thomas.
According to the article, Senators Sheldon Whitehouse of Rhode Island and Ron Wyden of Oregon sent a letter to Attorney General Merrick Garland requesting the appointment of a special counsel to investigate whether Thomas had violated any ethics, false statement, or tax laws. This represented a significant escalation in efforts to scrutinize Thomas over controversies related to ethics issues during his time on the Supreme Court. If approved, it would be the first time a special counsel investigated a sitting Supreme Court justice.
As the reason for the request, the senators cited several instances where Thomas appeared to have failed to properly disclose gifts and benefits he had received from wealthy supporters. This included a $267,000 loan Thomas used in 1999 to purchase a recreational vehicle, portions of which may have been forgiven without being declared as income. Travel on private jets and stays at luxury homes were also financed by benefactors but not always reported on Thomas’ financial disclosure forms as required. Additional concerns involved $25,000 in consulting fees paid to Thomas’ wife by a major Republican donor.
While the Justice Department has the authority to appoint a special counsel to investigate the matters, some experts noted it could be seen as politically motivated given Thomas’ conservative rulings. Thomas and his attorney had maintained any reporting oversights of gifts and travel were inadvertent and he strived for transparency. However, the senators argued the accumulated evidence suggested willful violations of federal ethics and tax rules. If proven, these could carry criminal penalties.
As the judiciary committee pursued answers on the appropriate handling of the issues, last month three previously undisclosed flights financed by one donor were revealed. Thomas also amended financial disclosures. However, the senators and others remained unsatisfied and sought an independent investigation through a special counsel to resolve lingering ethical questions around the Supreme Court justice.
