On Thursday, June 5, 2025, KXLG Radio reported that all judges in the Third Judicial Circuit of South Dakota have recused themselves from a high-profile case involving Margaret Jean Spears-Pederson, a 67-year-old woman from Watertown. This decision comes in light of Spears-Pederson’s familial ties to the judiciary. Her former husband, Judge Robert Spears, has a connection to the circuit, prompting concerns over potential bias.
The indictment against Spears-Pederson was announced by South Dakota Attorney General Marty Jackley, who revealed that she is facing one count of Grand Theft. The charges allege that she unlawfully took control of funds belonging to 16 individuals, with the total amount estimated between $100,000 and $500,000. The alleged offenses occurred within Codington County from January 1, 2023, to January 1, 2025. If convicted, Spears-Pederson could face a maximum sentence of 15 years in prison.
Spears-Pederson is the owner of Pederson Travels in Watertown, and her case has drawn considerable attention due to the serious nature of the allegations. Following her indictment on May 22, 2025, she made her initial court appearance on June 4, 2025, where her bond was set at $50,000 cash surety.
In light of the recusal of the Third Judicial Circuit judges, the South Dakota Supreme Court has appointed Retired Judge Mark Barnett to oversee the case.
