On Monday, September 30, 2024, Florida Today reported that State Representative Randy Fine has formally requested the Florida House leadership to initiate impeachment proceedings against Circuit Judge Scott Blaue. This move escalates Fine’s ongoing criticism of the judge, who is presiding over a contempt of court case involving Fine himself.
The call for impeachment follows a series of legal disputes between Fine and Judge Blaue, particularly surrounding Fine’s behavior during a virtual court hearing on August 19. During this session, Fine was captured on video making offensive gestures, including an apparent middle finger. The hearing was related to a lawsuit aimed at Fine’s removal from the ballot for a local GOP leadership position, filed by his political opponent, Robert Burns.
In response to the incident, Judge Blaue ordered Fine to appear in court to address the allegations of misconduct. He expressed concerns that Fine’s actions could undermine the dignity and authority of the court. Fine has denied any wrongdoing and has sought to challenge Blaue’s authority, filing multiple motions to delay the hearing and disqualify the judge. However, Blaue has consistently denied these requests, insisting that the contempt hearing will proceed.
Fine’s request for impeachment is built on allegations of misconduct he claims have occurred throughout the case. He has accused Judge Blaue of bias and of misusing Fine’s legislative title in court filings. Fine also linked a court order that required him to be served as an “interested party” in the case to threats against his safety, which he reported led to an arrest earlier this month.
The situation has intensified as Fine suggests that Judge Blaue’s actions reflect a disregard for the constitutional separation of powers. In a letter to House leadership, Fine asserted that Blaue’s conduct poses a risk not only to legislators but also to ordinary citizens. He expressed concern over what he perceives as a troubling precedent in which a judge could investigate and punish elected officials for their official actions.
Additionally, Fine has raised questions about potential conflicts of interest in the case, specifically regarding an independent attorney ad litem appointed by Blaue to investigate the matter. Fine noted that this attorney had previously donated to Blaue’s 2022 election campaign, further fueling his allegations of bias.
