On Wednesday, August 14, 2024, The Washington Times reported that U.S. District Court Judge Reed O’Connor recused himself from an antitrust lawsuit filed by the social media company X against the Global Alliance for Responsible Media (GARM).

The recusal came after a National Public Radio report recently revealed that Judge O’Connor owned financial holdings in Tesla. Judge O’Connor’s financial disclosures also revealed that he has holdings in Unilever, one of the defendants in X’s antitrust lawsuit.

According to the article, X had launched its antitrust lawsuit against GARM last week, accusing the advertising coalition of illegally conspiring to boycott the site and undermine the company by scaring away advertisers.

Judge O’Connor was presiding over this case as well as a separate lawsuit filed by X against Media Matters, a liberal nonprofit accused of publishing false information about the social media firm. However, the discovery of Judge O’Connor’s $15,000 to $50,000 investment in Tesla, whose CEO Elon Musk could be seen as aligned with X, immediately raised questions about the judge’s impartiality in the case.

Cases in the U.S. District Court of Northern Texas, where Judge O’Connor sits, are assigned according to the division where they are filed. However, the revelation of the judge’s financial connections to entities related to the litigation obliged him to recuse himself from the GARM lawsuit to avoid any potential conflicts of interest.

X’s antitrust suit is considered a high-profile legal challenge mounting from the platform concerning its advertising issues. Within a week of the case being filed, a separate social media company called Rumble also announced plans to support X’s legal battle. Despite facing the litigation, GARM said last week it would dissolve itself while using remaining funds to fight X’s lawsuit.
