On Friday, August 23, 2024, Bloomberg Law reported that David R. Jones, a former prominent bankruptcy judge in Houston, continues to have ramifications on the local court system over allegations involving a secret romance.
Jones was once one of the most prolific judges handling large corporate bankruptcies before he resigned in October 2022 after admitting to a long-term relationship with Elizabeth Freeman, a former partner at Jackson Walker LLP who had frequently appeared before him in court. This relationship has since sparked litigation and frustration among current judges who are dealing with the fallout.
The U.S. Trustee’s Office, a division within the Department of Justice that oversees bankruptcy, has launched a civil probe looking into legal fees approved by Jones during cases where Jackson Walker was involved. So far, the investigation has identified over 30 bankruptcy cases that are being scrutinized. As part of its fact-finding, the Trustee is considering interviewing three current Houston bankruptcy judges – Eduardo V. Rodriguez, Christopher Lopez, and Marvin Isgur – as well as Joshua Sussberg, a prominent restructuring partner at Kirkland & Ellis LLP.
Testifying could pose conflict-of-interest issues for the judges, as some of the cases under investigation are now being handled within their court, and they had previously worked alongside Jones. Professors of legal ethics noted judges would need to recuse themselves from related matters if they are compelled as witnesses.
The probe seeks to determine whether Jackson Walker should return up to $18 million in fees, alleging the firm should have disclosed the relationship between Freeman and the presiding judge. Jackson Walker maintains it was unaware of the full extent of their romance. Kirkland & Ellis, which often partnered with Jackson Walker on cases before Jones, is also involved as the Trustee plans to depose Sussberg and possibly other Kirkland attorneys next month.
Kirkland has since stopped filing major cases in Houston’s bankruptcy court. Sussberg is a high-profile figure that could be negatively impacted given his prominence in large restructurings. The issues have already raised lawsuits against both Kirkland and Jackson Walker accused of knowing about the relationship, though the cases have been dismissed.
Going forward, Judges Rodriguez, Lopez, and Isgur now have the significant task of overseeing various aspects of the sprawling probe. Rodriguez is handling pre-trial issues, while Lopez and Isgur are set to preside over dozens of fee disputes and sanctions trials as the investigation looks to recoup potentially millions of dollars from legal parties. However, their own involvement as witnesses could force them to recuse from related matters moving forward.
