Prosecutors filed a two-page response stating that there are no legal or factual grounds for Judge Cannon to withdraw from the case. They emphasized that Routh’s motion lacked sufficient authority or precedent to warrant her recusal, highlighting that judges are only required to step aside when valid reasons exist.
The defense team, comprised of two assistant public defenders, had previously argued that several factors warranted Judge Cannon’s removal from the case. Their claims included references to Cannon’s past rulings, particularly a dismissal of a federal case involving Trump related to classified documents. They pointed out that Trump had publicly praised Cannon for that dismissal and other decisions favorable to him, suggesting these factors could create a perception of bias.
Additionally, the defense noted that Trump appointed Cannon to her judicial position in the Southern District of Florida, raising concerns about the appropriateness of her involvement in Routh’s case. They argued that public suspicion regarding her assignment to the case could undermine the integrity of the proceedings.
While the defense brought up Trump’s comments and his ongoing presidential campaign, prosecutors did not address these remarks in their filing. Instead, they referenced a 2021 ruling from the U.S. Court of Appeals for the 11th Circuit, which dismissed a similar claim of recusal based solely on the identity of the president who appointed a judge.
In related developments, Judge Cannon has rescheduled Routh’s jury trial to February 10, 2025, moving it from its original date of November 18, 2024. She also adjusted several key pre-trial dates to late November, December, and early 2025.
Routh, 58, is facing five criminal charges, including the attempted assassination of a major presidential candidate. The charges stem from an incident last month when Routh allegedly attempted to shoot Trump while he was at the Trump International Golf Club.
According to the indictment, Routh was observed staking out the golf course with a loaded semiautomatic rifle. He was intercepted by a Secret Service agent who, noticing Routh before he could take any action, fired shots in his direction. Routh subsequently fled the scene but was apprehended by local authorities on Interstate 95.
Routh has pleaded not guilty to the charges against him. The case continues to attract significant media attention, particularly given its high-profile nature involving a former president and the serious allegations against Routh.
