Morgan, Jr., judge of the 13th Judicial Circuit Court in South Carolina, has recused himself from overseeing a lawsuit involving the family of Mallory Beach. This case, one of the last legal proceedings connected to the Murdaugh saga, centers on the family’s allegations against Gregory Parker, the owner of a convenience store chain. The Beach family contends that Parker leaked confidential photos of Mallory Beach’s body following her tragic death in a boating accident.
The recusal was prompted by a request from the attorneys representing the Beach family, who expressed concerns about a potential conflict of interest. They highlighted that a law clerk recently hired by Judge Morgan had previously interned for an attorney representing Parker. This situation raised questions about the appearance of impropriety, leading the Beach family’s legal team to argue for the judge’s withdrawal from the case, citing the South Carolina Code of Judicial Conduct.
In an order filed on October 18, Judge Morgan acknowledged the concerns but stated that he found “no impropriety” in his ability to continue overseeing the case. Nevertheless, after careful consideration of the arguments presented, he decided to step down to maintain the integrity of the judicial process and avoid any appearance of bias.
Mallory Beach, a 19-year-old resident of Beaufort, died in February 2019 when a boat operated by Paul Murdaugh crashed into a bridge at Parris Island. Paul Murdaugh, who was later murdered, was charged with felony boating under the influence in connection with the incident. Following the crash, Beach’s body was discovered eight days later. The incident marked the beginning of a complex legal saga that has entangled the Murdaugh family and various entities, including Parker’s Kitchen, where alcohol was sold to the underage Murdaugh.
In July 2023, Parker’s Kitchen reached a settlement of $15 million to resolve a wrongful death claim brought by Beach’s family. However, the subsequent lawsuit against Gregory Parker continues. This lawsuit alleges that Parker, along with a former CNN journalist and private investigators, conspired to inflict emotional distress on the Beach family by leaking images and other sensitive information as they pursued their wrongful death claims.
Both parties have accused each other of being the source of the leaked materials. The original lawsuit was filed shortly after the boating accident, which resulted in significant media coverage and public interest. The Murdaugh case has since escalated, drawing attention due to the high-profile nature of the individuals involved. Alex Murdaugh, the father of Paul Murdaugh, was convicted of the double murder of his wife and son in March 2023 and is serving two consecutive life sentences without the possibility of parole.
