On Friday, September 12, 2025, Norman V. Whiteside filed a petition for a writ of mandamus in the Supreme Court of Ohio against Franklin County Judge Andy Miller.

Whiteside’s petition alleges that Judge Miller has failed to rule on a motion in case number 85CR002396C that has been before his court since April 18, 2023.

Whiteside claims he has a clear legal right to the relief sought, that Judge Miller has a clear legal duty to perform the act of ruling on the motion, and that he has no other adequate remedy at law. He argues that the delay in ruling on the motion is causing him irreparable harm, hindering his aspiration to become an attorney. Whiteside cites Ohio Superintendent Rule 40 (3), which states that “all motions shall be ruled upon within one hundred twenty days from the date the motion was filed.”

The petition includes an email from Judge Miller’s bailiff/law clerk, indicating that the judge is aware of the motion.

Whiteside is seeking a writ of mandamus to compel Judge Miller to rule on the motion. In the filing, he requests that the court issue the writ forthwith, or issue an alternative writ, and grant any other relief to which he may be entitled.
