On Monday, March 23, 2026, Rodney Lomax filed an original action in quo warranto with the Supreme Court of Ohio, challenging the authority by which he was dispossessed from a property located in Warrensville Heights, Ohio.

The action names Judge Nicholas A. Papa, in his official capacity as a judge of the Bedford Municipal Court, as a respondent. Also named as respondents are the Bedford Municipal Court itself, Thomas E. Day, Jr., the Clerk of Court, and Shiv Shaktee LLC, doing business as Highlander Inn.

Lomax’s complaint stems from an eviction action filed in Bedford Municipal Court under Case No. 26CVG00528 by Shiv Shaktee LLC, which resulted in a writ of restitution being granted on March 6, 2026, and subsequently executed. Lomax argues that Shiv Shaktee LLC did not establish a legally sufficient transfer, assignment, or continuity of possessory rights to the premises. He claims the documentation provided consisted only of a tax/property record and an LLC registration identifying Vinod Maisuriya as an agent.

Lomax’s filing states that there was no deed, lease, assignment, or instrument presented that established lawful possession rights in Shiv Shaktee LLC. Lomax contends that the plaintiff alternatively characterized him as a “hotel guest” while invoking statutory eviction procedures. He further asserts that his filings, which challenged the authority, were deemed motions and stricken from the record.

Lomax is seeking a writ of quo warranto to require the respondents to demonstrate the authority by which judicial power was exercised in Case No. 26CVG00528. He is also asking the court to determine whether such authority was lawfully established and to grant any further relief as justice requires. The case challenges the authority of public actors and quasi-public actors affecting the Relator’s possessory rights.
