On Monday, May 19, 2025, Yellowhammer News reported that Alabama Supreme Court Justice Jay Mitchell resigned to pursue the Republican nomination for Attorney General in the 2026 election.
Mitchell, aged 48, began his tenure on the Alabama Supreme Court in January 2019 after being elected in 2018. A Mobile native, he graduated from Birmingham-Southern College and earned his law degree from the University of Virginia School of Law. Before his judicial role, Mitchell was a partner at the Birmingham-based law firm Maynard, Cooper & Gale, now known as Maynard Nexsen.
Governor Kay Ivey is expected to name Mitchell’s replacement on the court. May 19, 2025 is the start of fundraising for the 2026 primary election, set for May 19, 2026, following a measure signed by Ivey to adjust the campaign start date to accommodate probate judges around Memorial Day.
Other potential Republican candidates for the Attorney General position include Blount County District Attorney Pamela Casey, Katherine Robertson, longtime general counsel to current Attorney General Steve Marshall, and Lloyd Peeples, an Assistant U.S. Attorney for Alabama’s Northern District.
The seat is open as Marshall is term-limited, having first been elected in 2018. Mitchell’s campaign reported $654,304.40 in cash on hand as of his latest year-end fundraising report, available for his 2026 Attorney General bid.
