On Thursday, October 10, 2024, NBC10 Boston reported that attorneys representing Dzhokhar Tsarnaev, convicted in the Boston Marathon bombing, are seeking a new judge for the ongoing investigation into allegations of juror bias.

The defense argues that U.S. District Judge George A. O’Toole Jr., who presided over Tsarnaev’s 2015 death penalty trial, should recuse himself due to his public comments regarding the case. They claim his appearances on a podcast and participation in panel discussions have compromised the judicial process, violating the judicial code of conduct.

The U.S. Attorney’s Office has countered the defense’s request, asserting that the judge’s comments did not address the specifics of the case itself.
