On Monday, February 3, 2025, WLKY reported that John Miller, a former Clark County council member, had his request for a new judge denied in connection with the ongoing Jamey Noel investigation. The ruling came from Judge Larry Medlock, who stated, “Wherefore, the motion of change of venue from the judge is denied.”
Miller had previously secured a change of venue, but the prosecution and defense could not agree on a new location. His latest plea for a new judge stemmed from claims of bias after he was denied permission to attend the presidential inauguration. Judge Medlock responded to these claims, asserting his impartiality: “Just because I didn’t grant his request to attend an inauguration in Washington DC doesn’t mean I’m biased or prejudiced or cannot oversee this case impartially.”
Following the denial of the venue change, Miller’s defense team sought to dismiss the charges against him, arguing that the allegations were unclear. Miller faces accusations of failing to disclose gifts received from Noel before voting to fund New Chapel EMS. His attorney, Bart Betteau, criticized the charges, stating, “The underpart here has always been that Miller is a dirty SOB,” suggesting that other council members should also be held accountable as they voted unanimously for the contract.
Prosecutors, however, maintain that there is sufficient evidence to support the charges against Miller. Prosecutor Ric Hertel noted that the defense had been provided with an extensive amount of evidence, including an 18-page probable cause affidavit and numerous witnesses.
Judge Medlock acknowledged that both sides presented compelling arguments and indicated that he would take time to consider the case before making a final decision. No timeline has been announced for when this decision will be made.
