On Friday, August 1, 2025, NBC Boston reported that during a procedural hearing for Brian Walshe’s upcoming murder trial, Judge Diane Freniere disclosed a potential conflict of interest linked to her relationship with an attorney involved in the prosecution. The hearing took place as preparations continue for the trial, which is scheduled to begin on October 20.

Judge Freniere revealed that she has a personal connection with Michael Sullivan, who will be collaborating with Norfolk County prosecutors in their dealings with the U.S. Attorney’s Office. Sullivan, a former U.S. Attorney for the District of Massachusetts from 2001 to 2009, is both a mentor and a friend to the judge.

In light of this relationship, Judge Freniere stated that she had considered whether she could remain impartial and felt confident in her ability to make fair decisions. However, she emphasized the importance of transparency, advising the involved parties to consult with their clients regarding her disclosure.

Brian Walshe’s attorney, Larry Tipton, indicated his intention to discuss the matter with his client. The Commonwealth may also seek to address the issue. Judge Freniere noted that if either party feels uncomfortable proceeding with her, she would refer the case to Judge Krupp.

Following the hearing, Judge Freniere allowed Tipton to confer with Walshe via Zoom. The matter has been postponed until the following week to allow for further discussion. A final pretrial hearing is set for October 7, leading up to the trial’s commencement later that month.
