On Thursday, May 9, 2024, the Daily Caller reported that the New York State Commission on Judicial Conduct has launched an investigation into Judge Arthur Engoron for allegedly having an improper conversation with a lawyer regarding the lawsuit against former President Donald Trump.

The investigation arises from comments made by real estate attorney Adam Leitman Bailey in a February interview with NBC New York. Bailey said he spoke to Judge Engoron three weeks before the judge was set to rule on the civil fraud case brought against Trump by New York Attorney General Letitia James. Bailey claimed he approached Engoron in the courthouse and told the judge what his views were on the case in hopes of influencing how Engoron would decide.

Judge Engoron has denied that any inappropriate discussion took place. A spokesman for the judge said the February 16th ruling against Trump was Engoron’s decision alone and was not impacted by any conversations with outside parties. However, the New York State Rules of Judicial Conduct strictly prohibit judges from having ex parte communications or considering outside communications about pending cases without all parties present.

The New York State Commission on Judicial Conduct, which oversees attorney conduct, is now examining whether Judge Engoron violated these rules by reportedly accepting legal advice from Bailey before issuing his judgement against Trump. As the watchdog organization for New York judges, the Commission has the authority to investigate complaints and impose sanctions if misconduct is found to have occurred. However, due to its statutory confidentiality requirements, the Commission’s Administrator declined to provide any details about the current probe involving Judge Engoron.

The new investigation represents yet another development related to the ongoing civil lawsuit filed against Trump for alleged fraudulent business practices. It remains to be seen what findings the Commission on Judicial Conduct may make public once their review of the interaction between Judge Engoron and Attorney Bailey is complete.
