Senator Anthony Palumbo, ranking member of the Senate Judiciary Committee, and Assemblymember Michael Tannousis, ranking member of the Assembly Judiciary Committee, along with other Republican members, made the announcement.
The complaint stems from Chief Judge Wilson’s recent appearance at a forum held by the Communities not Cages advocacy group, where he reportedly referred to the state’s sentencing laws as “stupid” and encouraged attendees not to vote for judges who do not align with his views on sentencing. The lawmakers argue that these comments constitute political activity, which is strictly prohibited for judges under New York State law.
Senator Palumbo stated that Chief Judge Wilson’s remarks at the CUNY Law Symposium were inappropriate and cast doubt on his ability to remain impartial. He emphasized that the role of New York State’s top judge is to ensure the fair and impartial administration of laws, asserting that political opinions have no place within the judiciary.
Senator Rhoads echoed these concerns, emphasizing that New Yorkers are entitled to a judicial system that is fair and apolitical. He noted that the Chief Judge’s public criticism of enacted laws and his call to reject dissenting judges raise serious questions about the court’s neutrality.
Senator Patricia Canzoneri-Fitzpatrick added that judges should lead by example and adhere to ethical rules, especially those in the highest positions within the court system. She stressed the need for a thorough review to maintain the integrity of the judicial system.
Senator Palumbo concluded by urging the Commission on Judicial Conduct to review the complaint without affording Chief Judge Wilson any special treatment.
