In the interview that aired Sunday, Gorsuch warned Americans to “be careful” about pushing reforms to the independent judiciary. He explained that the judiciary exists to ensure those who are unpopular or have the government targeting them still receive a fair trial under the law. Some viewed this as a veiled threat, though the justice maintained he was simply encouraging vigilance over any changes.

Gorsuch’s remarks came in response to plans unveiled by President Biden to increase accountability and independence on the Supreme Court. If passed, the proposals would establish term limits for justices, block a recent ruling on presidential immunity, and implement a mandatory ethics code for the bench. The changes are aimed at reducing partisan influence and potential conflict of interest.

Critics argued it was inappropriate for a sitting justice to weigh in politically on proposed reforms through a one-sided media interview. Former DOJ official Harry Litman called Gorsuch’s appearance “remarkably out of line” and questioned why he was discussing the topic on Fox News specifically. Others on social media platforms accused Gorsuch of threatening rhetoric in his “be careful” statement directed at the public.

However, the piece also noted justices are not formally banned from politics and that Gorsuch denied allegations his words were meant as a threat when pressed on them in a separate New York Times interview.
