Judge Merchan is presiding over the criminal trial against Trump relating to charges that he falsified business records through hush money payments.
Trump’s lawyers have claimed Judge Merchan should recuse himself due to his daughter Loren Merchan’s work history with Vice President Kamala Harris. Loren is the president of a political consulting firm called Authentic Campaigns, and she has worked on campaigns for Kamala Harris and other Democratic politicians in the past. Trump’s lawyers argue this could present a conflict of interest now that Harris is the Democratic nominee for president in the 2024 election.
However, Judge Merchan has denied previous recusal requests from Trump, asserting he can be fair and impartial. An ethics panel also previously found no reason for Merchan to recuse. In this latest request, Trump’s attorneys argued Loren’s ongoing relationship with Harris takes on new significance with her in the White House.
Prosecutors from the Manhattan District Attorney’s office oppose the recusal bid. They claim Trump’s arguments are the same as before and that he offers no new factual basis. They characterized the request as “vexatious and frivolous.”
Judge Merchan stated in his letter on Tuesday that he will rule on the recusal motion by August 16th. He is still planning to sentence Trump on September 18th if he maintains the guilty verdict. Merchan had delayed sentencing after the US Supreme Court’s ruling in Trump v. US regarding presidential immunity claims.
The judge pushed the deadline for ruling on Trump’s motion to set aside the guilty verdicts back two days to September 16th as well. His letter affirmed the other key dates in the case remain unchanged unless noted. Overall, the case has proceeded, with Judge Merchan continuing to reject arguments that family ties require his recusal.
