On Friday, July 18, 2025, RIFuture.news reported that former State Senator Michael McCaffrey was selected by the Rhode Island Judicial Nominating Commission as one of five candidates for a District Court vacancy.

The vacancy follows the resignation of Associate Justice Melissa DuBose, and the final appointment will be made by Governor Daniel McKee.

The commission’s decision came during a hearing, where six of the eight members present voted to advance McCaffrey, with only Chair Krystle Tadesse and member Lamel Moore dissenting.

McCaffrey, who served in the Rhode Island Senate for nearly three decades, faced scrutiny for his legislative record, particularly his votes against bills supporting reproductive rights and LGBTQ+ equality. During his tenure, he opposed key legislation, including the 1995 LGBT Civil Rights bill, the 1998 sodomy law repeal, the 1998 Hate Crimes Law, the 2001 transgender civil rights law, domestic partner benefits for state employees in 2001, and Marriage Equality, which Rhode Island passed in 2013. McCaffrey also voted against codifying Roe v. Wade in 2019.

At the hearing, McCaffrey acknowledged his past votes but stated that his views have evolved. He emphasized that as a judge, he would remain neutral, apply state law impartially, and treat all individuals with dignity. McCaffrey also highlighted his role in Senate leadership, noting that certain bills, including Marriage Equality and Roe v. Wade codification, reached the Senate floor due to leadership decisions.

The commission heard from other candidates, including Rebecca Alitchison, Maria Deaton, Anthony DiBiase Jr., and Robert Johnson IV, all of whom expressed support for reproductive and LGBTQ+ rights.

Commission members Thomas Casale and James Lepore defended McCaffrey, praising his character and fairness based on their personal experiences with him.

The list of candidates has been forwarded to Governor McKee, who will make the final appointment, subject to Senate confirmation.
