NY Judges Permitted to Swear In Not-for-Profit Contractors’ Association Board Members
The New York Advisory Committee on Judicial Ethics has issued Opinion 26-36, clarifying the permissible activities for full-time judges.
The opinion addresses whether a judge can administer an oath of office to new board members of a not-for-profit contractors' association, even if the judge is not within their election or re-election window.
The committee concluded that a judge is not restricted by their election window to attend non-political events sponsored by trade associations.
Citing a previous opinion regarding a realtors' association convention, the committee stated that a judge may perform such a function as long as the event is not a fund-raiser.
Therefore, a full-time judge may swear in new board members for a contractors' association, provided the event is neither a political gathering nor a fund-raiser.
